At TufaLoans, Inc., doing business as FamilyBacked (“FamilyBacked,” “we,” “our,” or “us”), we operate as a licensed mortgage broker. This Privacy Policy explains how we collect, use, and share your personal and financial information when you apply for a mortgage or use our shared ownership platform.

1. Information We Collect for Mortgage Brokerage
To provide mortgage brokerage services, we must collect highly sensitive "Non-Public Personal Information" (NPI):
- Identity Data: Name, Social Security number, date of birth, and government-issued photo identification.
- Financial Data: Tax returns (1040s), W-2s, pay stubs, bank statements, investment account details, and existing debt obligations.
- Credit Data: We pull your credit report and score from national credit bureaus (Equifax, Experian, and TransUnion) to determine loan eligibility.
- Property Data: Information regarding the home you intend to purchase, including the purchase contract and appraisal reports.
2. How We Use Your Information
- Loan Origination: We use your data to prepare your mortgage application and determine which loan products meet your needs.
- Wholesale Submission: We submit your completed application, credit report, and supporting financial documents to our wholesale lender partners, such as United Wholesale Mortgage (UWM), for underwriting and funding.
- TIC Coordination: We use your data to draft the Home Ownership Agreement that defines the Tenancy In Common structure between you and your family members.
3. Sharing Your Information
We do not sell your personal information. As a mortgage broker, we share your data only as necessary to fulfill your loan request:
- Wholesale Lenders: We share your full application file with our lending partners (e.g., UWM) so they can underwrite and fund your mortgage.
- Service Providers: We share data with third parties who provide credit reports, flood determinations, and identity verification.
- Closing Agents: We share data with title companies, escrow agents, and attorneys to coordinate the final settlement and recording of the deed.
- Family Participants: With your consent, we coordinate specific transaction details with the family members sharing a stake in your home.
4. Financial Privacy and Your Rights (GLBA)
Under the Gramm-Leach-Bliley Act, you have the right to know how we share your information.
- No Marketing Sharing: We do not share your non-public personal information with non-affiliated third parties for their own marketing purposes.
- Access and Accuracy: You may request to review the information we have collected and ask for corrections to any inaccuracies.
5. Data Security and Retention
We utilize bank-level encryption and secure "Upload Portals" to protect your financial documents. We retain your records as required by the SAFE Act and other state-specific record-keeping regulations for mortgage brokers.

The "Broker-Lender" Workflow for your site
When your users get to the "Document Upload" stage, you should have a checkbox that says:
"I authorize FamilyBacked to share my credit report and financial documentation with third-party wholesale lenders (including United Wholesale Mortgage) for the purpose of obtaining a mortgage loan."
